This website is operated by Bendio. Throughout the site, "we", "us" and "our" refer to Bendio. By visiting bendio.co or buying from us, you agree to these Terms of Service and to the policies they refer to (our Privacy Policy, Refund Policy and Shipping Policy). If you do not agree, please do not use the site.

Our store is hosted on Shopify, which provides the online platform that lets us sell our products to you.

1. Using our store

By agreeing to these terms, you confirm that you are at least the age of majority where you live. You may not use our products or this site for any illegal or unauthorized purpose, or transmit any viruses or code of a destructive nature. Breaking any of these terms ends your right to use the site.

2. General conditions

We may refuse service to anyone for any reason at any time. Your content, not including card information, may be transferred unencrypted across networks; card information is always encrypted during transfer. You agree not to copy, sell or exploit any part of the site without our written permission.

3. Accuracy of information

We work to keep the information on this site accurate and up to date, but it is provided for general information only and may not be complete. Bendio is a comfort and support accessory, not a medical device, and nothing on this site is medical advice. If you have questions about a knee condition, please ask your doctor.

4. Prices and changes

Prices may change without notice. We may change or discontinue any product or part of the site at any time. We are not liable to you or anyone else for any change in price, suspension or discontinuance.

5. Products

We show our products and their colors as accurately as we can, but we cannot guarantee that your screen shows any color exactly. We may limit quantities, and we may limit sales to any person or region. If a product is not right for you, our 60-day Refund Policy applies.

6. Orders and billing

We may refuse or cancel any order, for example orders that appear to be placed by dealers or resellers. If we change or cancel an order, we will try to contact you using the email or billing address you gave us. You agree to provide current, complete and accurate purchase and account information.

7. Refunds and shipping

Our Refund Policy gives you 60 days to decide, with a full refund and no restocking fee. Shipping details are in our Shipping Policy. Both form part of these terms.

8. Third-party tools and links

We may give you access to tools or links from third parties that we neither monitor nor control. You use them at your own risk and under the terms of those third parties.

9. Reviews, comments and feedback

If you send us reviews, ideas, suggestions or other feedback, you agree that we may edit, copy, publish and otherwise use them in any medium without compensation. You agree that your comments will not be unlawful, abusive or misleading, will not infringe anyone's rights and will not contain viruses or malware.

11. Errors and omissions

The site may occasionally contain typographical errors, inaccuracies or omissions about product descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct them and change or update information, or cancel orders, at any time without prior notice, including after you have submitted your order.

You may not use the site or its content for any unlawful purpose; to solicit others to act unlawfully; to violate any regulation or law; to infringe our intellectual property or that of others; to harass, abuse or discriminate; to submit false or misleading information; to upload malicious code; to collect personal information of others; to spam or scrape; or to interfere with the security of the site.

13. Disclaimer of warranties and limitation of liability

To the extent permitted by law, the site and all products are provided "as is" and "as available", without warranties of any kind beyond those set out in our policies, and we are not liable for any indirect, incidental, special or consequential damages arising from your use of the site or any product. Our total liability for any claim relating to a product is limited to the amount you paid for it. Some places do not allow these limitations, so they may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Bendio and its partners, officers, employees and suppliers from any claim or demand made by a third party because of your breach of these terms or your violation of any law or the rights of a third party.

15. Severability, termination and entire agreement

If any part of these terms is found unlawful or unenforceable, the rest remains in effect. These terms apply until ended by you or us; you can end them at any time by no longer using the site. These terms and the policies they refer to are the entire agreement between you and us about the site.

16. Governing law

These terms are governed by the laws of the State of Wyoming, United States.

We may update these terms by posting changes on this page. Continuing to use the site after changes are posted means you accept them.
